Fan-created Edits: The Legal Gray Area of Edit Culture

The Rise of Fan Edits on Social Media

Are you on TikTok, Instagram Reels, and other social media platforms? If so, there is a very high chance you have watched a fan-created edit. Whether it was a Super Bowl edit of your favorite player or one of your favorite Grey’s Anatomy characters, they are hard to escape. Fan-created edits are essentially short videos in which users remix clips from popular media, combining music, visual effects, and rapid editing. These edits can reach millions of views and influence a show’s popularity. Although these edits are widely celebrated for their creativity, they also raise important legal questions about copyright law. Many creators rely on the doctrine of fair use to justify their work, which allows the limited “unlicensed use of copyright-protected works in certain circumstances” (U.S. Copyright Office, 2023). However, the line between transformative creativity and copyright infringement remains blurred, even though many edits reinterpret original content by adding new meaning, emotion, and perspective rather than simply copying the material. 

Participatory Culture 

The rise of edit culture signals a shift in how audiences relate to entertainment media. Instead of passively consuming television and movies, fans now remix and reinterpret content. Coined by Henry Jenkins, this relationship is categorized as participatory culture (Jenkins et al., 2006, p. 5). Fan edits often highlight specific characters, relationships, and emotional moments, and usually offer a new spin.

The growing influence of fan edits has even attracted attention from major entertainment studios. For example, Lionsgate, a major film studio, has even begun hiring TikTok creators who produce fan edits to create promotional content for its projects. The goal is to attract younger audiences and grow engagement with Lionsgate’s content (Shanfeld, 2025). This recent development demonstrates that fan-created content is no longer niche but has become a powerful tool in modern advertising. 

Copyright Law and the Fair Use Doctrine

Even though fan-created edits are creative, most rely on copyrighted material owned by studios, networks, and production companies. U.S. copyright law grants the creator exclusive rights over their work, particularly reproduction and distribution (U.S. Copyright Office, 2025). However, the doctrine of fair use was established by the 1976 Copyright Act, which provides an exception under four factors: the purpose and character of the use (including whether the use is “transformative”?), the nature of the copyrighted work, the amount of the work used, and the effects of the use on the potential market for the original work (U.S. Copyright Office, 2023). These four factors help courts decide whether the new work contributes something new or reproduces the original.  

But in reality, the most important lens that courts often use is whether the alleged copyrighted work is “transformative,” assessing if the new work “add[s] something new, with a further purpose or different character” (U.S. Copyright Office, 2023). This concept of transformative work was established by the U.S. Supreme Court’s decision in Campbell v. Acuff-Rose Music, Inc. (1994), where the court unanimously (9-0) ruled that a parody of Roy Orbison’s song “Oh, Pretty Woman” qualifies as fair use since it was created for commercial purposes on the premise that the parody transformed the song with new meaning and expression (Campbell v. Acuff-Rose Music, Inc., 510 U.S. 569 (1994), n.d.). Given this standard, the question becomes whether TikTok fan edits should be treated similarly when they transform original material in comparable ways. 

Transformative Use and Its Role in the Courts

Courts determine whether fan edits qualify as transformative by examining whether they significantly reinterpret the original footage. In many cases, edits are transformative because they rearrange scenes, add music, and frame narratives in a way that creates a new perspective rather than simply reproducing the original material. These edits offer a new perspective and interpretive angle that transform the original material into an artistic expression, effectively creating something new from an existing work. Since these edits reshape meaning through music, pacing, and narrative focus, they function less as copies and more as creative reinterpretations that may fall within the scope of transformative use. Yet, courts evaluate fair use on a case-by-case basis, so a general outcome on whether fan-created edits are considered transformative varies from court to court.

DMCA Takedowns and Platform Responsibility

Beyond fair use analysis, social media platforms such as Instagram, Facebook, and TikTok all manage complaints through the Digital Millennium Copyright Act (DMCA) (Meta Platforms, 2026; TikTok, 2021). In Section 512 of the DMCA, platforms are protected from copyright liability for user-uploaded content as long as they swiftly remove the allegedly infringed material after receiving a copyright complaint (Copyright.gov, 2022). As a result, many fan edits are automatically taken down. Hence, the DMCA allows platforms like TikTok and Instagram to avoid the legal responsibility of copyright infringement, but in doing so, it creates uncertainty for creators who believe their work is either transformative or qualifies as fair use. 

Conclusion

Ultimately, the growing popularity of fan edits represents the ongoing tension between artistic creativity and intellectual property protection. On one hand, fan-created edits are a form of digital expression and foster camaraderie and deeper audience engagement with media. On the other hand, these copyright laws protect the economic rights of the original creators. It is likely only a matter of time before a Supreme Court case directly addresses the legal status of fan-created edits. However, instead of relying solely on the judicial branch, policymakers and platforms should take a more active role in clarifying how fair use applies to the edit world and remix culture. Clearer guidelines from social media platforms and the U.S. Copyright Office that recognize transformative fan edits while still protecting original works are imperative to reflect the realities of modern media consumption and participatory culture. Without these guidelines, both fan creators and content owners are left at a disadvantage if copyright laws continue to fall behind the creative practices they are meant to regulate.
